These Terms of Service ("Terms") govern your access to and use of ETHEREAL ("ETHEREAL", "we", "our", "us"), an operating system for elite tattoo studios operated by Global InkMagine LLC. By creating an account, connecting a Google or other third-party service, or otherwise using ETHEREAL, you agree to these Terms and to our Privacy Policy.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use ETHEREAL. By creating an account you confirm you have the authority to bind the studio or business you represent. You are responsible for safeguarding your credentials and for all activity under your account.
ETHEREAL provides software for tattoo studios and tattoo artists to run sessions, bookings, deposits, approvals, client communication, growth operations, and creative tooling. Optional integrations let you connect ETHEREAL to third-party services you authorize, including Google Calendar.
If you connect Google Calendar, ETHEREAL will request the OAuth scopes calendar.readonly and calendar.events as described in our Privacy Policy. You can revoke this access at any time via your Google Account permissions. ETHEREAL's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
You agree not to use ETHEREAL to: (a) violate any law or third-party right; (b) upload or transmit content that is illegal, infringing, harassing, or otherwise harmful; (c) interfere with or disrupt the integrity, security, or performance of ETHEREAL; (d) attempt to gain unauthorized access to any system, data, or account; (e) reverse engineer, scrape, or build a competing product from ETHEREAL output; or (f) use ETHEREAL to send unsolicited messages in violation of applicable law.
Some features require a paid subscription or are billed per use. Pricing is shown inside the application and may be updated with notice. Payment processing is handled by Stripe; declined or reversed payments may suspend access until resolved.
You retain ownership of the content, files, photos, designs, and data you submit to ETHEREAL ("Your Content"). You grant ETHEREAL a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process Your Content solely as necessary to provide and operate the service for you. We do not sell Your Content and do not use Google user data to train AI models.
ETHEREAL, the ETHEREAL marks, logos, and software are owned by Global InkMagine LLC and its licensors. Except for the limited license granted in these Terms, no rights are conveyed.
You may stop using ETHEREAL and disconnect any integration at any time. We may suspend or terminate access for material breach of these Terms, abuse of the service, or as required by law. On termination, the rights granted to you cease and we will handle your data per our Privacy Policy.
ETHEREAL is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that calendar synchronization will always be perfectly accurate; you remain responsible for confirming bookings with clients.
To the maximum extent permitted by law, neither ETHEREAL nor Global InkMagine LLC will be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill. Our aggregate liability for any claim arising out of or related to these Terms is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 100.
You agree to defend and indemnify ETHEREAL and Global InkMagine LLC from claims arising out of (a) Your Content, (b) your breach of these Terms, or (c) your violation of any law or third-party right.
We may update these Terms from time to time. Material changes will be announced in-app or by email before taking effect. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts of Delaware, USA, except where applicable consumer-protection law requires otherwise.
